Terms of Service
Last updated: October 2026
These terms apply when you use this website or engage Ciao Marketing (“we”, “us”, “our”) for websites, apps, SEO, advertising management, marketing automation, AI tools or related services (the “Services”). By engaging us or using this website you agree to these terms. If a written proposal or agreement we give you says something different, that document applies for that project.
Proposals and quotes
Before work starts we'll agree the scope, price and timing in writing, usually by proposal or email. Quotes are based on the information you give us and are valid for 30 days. Work outside the agreed scope is quoted separately before we do it.
Fees and payment
Project work may require a deposit before it starts, with the balance due on the dates set out in your proposal. Ongoing services such as advertising management, SEO or hosting are billed in advance each month. Invoices are payable within the terms shown on them. If an invoice stays unpaid, we may pause the related Services until it is paid. Prices are in Australian dollars and include GST where it applies.
Advertising spend
Your advertising budget is separate from our fees. Ad spend is paid by you directly to the platform (for example Google or Meta), through a payment method on your own account. The platform's own terms and policies apply to your ads, and the platforms decide whether ads are approved and how they're delivered.
Results
We work hard to get you results and will give you our honest advice, but we can't guarantee specific outcomes such as search rankings, traffic, leads, sales or return on ad spend. These depend on things outside our control, including search engine and platform changes, competition, your market, pricing and how enquiries are followed up. Any estimates or forecasts we give you are our best judgement, not promises.
Your responsibilities
To do the work well we need timely access, information and feedback from you, such as logins, content, images, approvals and answers to questions. You're responsible for making sure the material you give us is accurate, that you have the right to use it, and that your products, services and claims comply with the law. Delays in providing what we need may affect timelines.
Accounts and ownership
Your advertising accounts, analytics, domain and business profiles should be set up in your name, and we access them as a manager or user. Once the related work has been paid for in full, you own the website content, designs and creative we produce specifically for you. We keep ownership of our own tools, code libraries, templates and know-how, and you receive a licence to use them as part of your website or system. Third-party software, themes, plugins, fonts and stock images remain subject to their own licences. Unless you ask us not to, we may show work we've done for you in our portfolio, without disclosing confidential information.
Ending the arrangement
Ongoing monthly services continue month to month unless your proposal sets a minimum term. Either of us can end them with 30 days' written notice. When the arrangement ends, we'll hand back or remove our access to your accounts, and you pay for work done and services provided up to the end date. Project work can be ended early by either of us in writing; you pay for work completed up to that point.
Third-party services
Many Services rely on third parties such as hosting providers, Google, Meta, AI providers and software platforms. We're not responsible for their outages, policy changes, price changes or account decisions, though we'll help you deal with them where we can.
Confidentiality
We keep your business information confidential and only use it to provide the Services. Personal information is handled under our Privacy Policy.
Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the Services again or paying the cost of having them supplied again.
Limitation of liability
To the extent the law allows, we're not liable for indirect or consequential loss, including lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Services is limited to the fees you paid us for those Services in the three months before the claim arose.
Using this website
The content on this website is general information, not advice for your specific situation. We try to keep it accurate and up to date but don't guarantee it. You may not copy or reuse our content without permission, or use the website in a way that harms it or other users. Links to other websites are provided for convenience; we're not responsible for their content.
Changes to these terms
We may update these terms from time to time. The version on this page applies from the date shown above. Changes don't affect work already agreed in a signed proposal.
Governing law
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction.
